i mean, yah, you verified what i've been saying about track liability. but i already knew that, and so should anyone else who's got two functioning brain cells. this is what i don't want to happen.

we turn every on-track incident into a federal case and we'll kill auto racing faster than you can say "kill all the lawyers". and that's what will happen once you start that ball rolling.
I agree, we do not need lawyers getting involved, but at this point of the track wont take care of the situation it becomes a necessity. This should not even be a topic on here. The rules should have stood and been enforced properly.

Just remember, it may be you next, and you may not walk away.

      Oh Hell

Ok.. Bring on the lawyers and shut down what we all so dearly love to be around and do.... There are many things in our business which is fueled by adrenaline and sometimes anger... Some of which we regret dearly later... Some of which we don't until much later.. maybe a couple we don't... But the point that we all have to keep in mind is that we direly need to make our sport and our business (short track racing AND fan attraction)... I grew up when you had to get there an hour or two early for a race just too find a seat you could see from... Now it is a pathetic thing that we can't get fans in to fill half the stands... But the point of this whole thread from what I can understand originally is that we would all like to have it clarified what, if any, penalty She received... From what I can deem from earlier posts, there has been a difference in notification methods(if any) in the past...

        Ok...

Looking back at the original one from Rusty is that he was welcoming Jessica.. Did anyone ever think that maybe he wasn't notified of her penalty at NSS prior to the race... .

          Lets Review

Rusty may have not been told....but....
What does that say about the (mis)communication of the (mis)Management "TEAM" at FASCAR?

Rusty had a whole WEEK to be told..???..WTF He started this post, where is he now, you know that he knows it is going on? "don't say anything....The B.O.S.S. said so."

This BS is " all ATM (About The Money)"

By not making a public statement about this they have proved that they:
a)They don't care about the racers or fans
          b)Are still clueless
          c)Don't have the Balls
          d)All of the above

"But the point of this whole thread from what I can understand originally is that we would all like to have it clarified what, if any, penalty She received..."

That is correct, clarification (and some respect) is what this is about.
The penal-ty was clear and is listed in the above posts, the reason it was not upheald is what is in question.
Well....another week goes by, the suspension per the statement has not even started yet ....lets see where she turns up this weekend.

I can promise you if you hit me under caution enough to cause damage and the track or sanctioning body does nothing about it I will get a lawyer involved.

What if it was your kid that it happened to? It is a completely unreasonable thing to do and she should be banned FOREVER over it. Anything less is unacceptable.

you know i'm for drama and all ( gives the board the illusion it's not a cemetery ) but that's just a wee bit over the top.

we should have banned Michael Schumacher from F1 for that brake checking incident at Monaco(?) a couple of years ago?

Im sorry Todd but its just unexcuseable. I will build a strictly stock, come plow you under caution and see how your feelings change.

This happened under caution! Its bad enough for the track workers to worry about us while they are cleaning up the track when we are behaving. Throw in a temper tantrum and you have dead people on the track. Im sorry but you are just plain wrong. And nothing will convince me of that.

                  President McCreary is right.....again.....

Sorry oval....but you are being a tad bit over the top with the drama......good for a message board, bad for a Sat. night short track.

The way it looks, most of the commenters about this subject weren't even witness to this unimaginable, ALMOST tragedy. How many on track incidents have you observed where extenuating circumstances were involved and you just shrugged your sholuders and said, "Well, he got back what he was giving". Green, yellow, red, black.....it really doesn't matter when it happens. If I purposefully drive you across three lanes to stuff you in the wall, how is that any different from running into the back of your car under yellow? Both were done with malice and both meet the definition for assault.

This is auto racing for christ's sake.

Thats why we build em' with cages.

Don't wanna experience the danger factor? Stick to the Playstation. Unless your lawyers can find a way to sue the guy who walled you online for the emotional distress.

You pull over the wall you need to take the advice you gave for Hamlin. Pull your big boy panties up and man up. Leave your lawyers at the salad buffet.

One last thing about this whole endangerment of life deal: Did she jump off a ramp or something to only damage the part of the rear hoop that was above the door bars? Cuz the picture only showed that area as being replaced. If she hit him hard enough to damage that bar that high up then she must have torn the hell out of the door bars and the door panel.
                  Just a question.

Ok Osmosis. Here you go. What happens under green is racing. That I can live with. At least we are all going fast in the same direction. Slow things down and let someone take a shot is bad news.

Go read the thread about the track worker killed under caution at the little 500. Do you want more of that? Because thats what you risk with stupid crap like this happening. Its not as much about the drivers as it is about the guy picking up a piece of sheet metal or cleaning up some oil.

Racing is dying because of @ssholes that think they get to run people over under caution and then get out of trouble. That is one of the biggest problems racing has right now.

Until then unless you actually race, do not reply to a thing I have to say because I dont care what you have to say.

Do you want just the can or the 2 liter bottle?

What poll did I miss proclaiming you, Ovalracer44, as the Grand Exhalted Poobah over all that is, was and will ever be the sport of AUTO RACING?

Not that I've ever had to qualify my rights to post on here before but since you need to know, I was racing long before you were even out of the womb and have driven, built and crewed on more racecars than you can freaking daydream about.
So what the hell does that matter? It doesn't!
Just because you've won a few races and the coveted OSP Winter Heat Series Championship you think that you can come on a public message board and dictate terms to every one who has an opposing point of view? Good luck with that. Maybe your lawyers can help you get some satisfaction.

And since you responded to my post BEFORE you advised me not to respond to yours, I'll just address a few more points:

"Racing is dying because of @ssholes that think they get to run people over under caution and then get out of trouble. That is one of the biggest problems racing has right now."

Really. That's one of the biggest problems racing has right now. No..no...you're probably right....I probably skipped right over the crate motor war pages and the posts about rising costs and gas prices....not to mention the tire issues....and those random, few posts about promoters screwing the drivers and fans.....so I can see how being on a track with 20 other people who are as emotionally restrained as you seem to be could lead one to some serious stress issues.

"Go read the thread about the track worker killed under caution at the little 500."

Okay. I RE-read it. Youre telling me that the guy who hit him was hell bent on vengeance and was aiming for him? I missed that part of the story. I did see that it happened under yellow. That's is usually when the track workers are on the track.
The relevance of this incident to the other one is what?
                          That's right. None.

"Until then unless you actually race, do not reply to a thing I have to say because I dont care what you have to say."

This is just too funny to pick apart. Except to say that I'll post whenever I damn well feel like it, which hasn't been too much lately. But for someone who can rival carolwicks for posting comments about each and every topic and thread that comes down the pike, statements like that are just a little too

                          DRAMATIC

I say again, pull up your panties and stop going on about lawyers. Racing is not just a man's sport, anymore. But it's not for the faint of heart, either. I'll stand by what I wrote earlier. In my book, when you pull over that wall you just signed your liability waiver. ToysRus sells Nintendo for everyone else.

                            Oh hell...

Ok.. I didn't say anything about that... If it was my kid and it happened under caution.... Her/his Arse would have been turned up and beaten so badly that they wouldn't have been able to sit for a month.... Damn if I would have done that when I was young.... Oh boy, let's just say I would not probably be alive anymore...

Now... Honestly... retaliation is retaliation... But don't try it under caution... I am at NSS EVERY WEEK no matter what!!!!!! I am a supporter of short track whether as a driver or as a fan.... I hate being a fan, but Money (or lack of it) tells me that I am a fan for awhile... LOL... Can't wait to get the car(s) done...

Truthfully the only thing everyone is wondering is why the punishment/suspension/slap on the hand was not made public.... And why are the punishments not equal since the rules covering these are the same for quite a while....

i dunno? because Robert Hart and Don Nerone don't attend those?

and nobody who is at an OSW drivers meeting has the authority to make a decision in this matter anyway?

and if we browbeat Rusty about it, he'll just tell us that he has nothing to do with the Tour stuff and he can't issue rulings to them or explain their decision making to us?

let me know when i'm getting close.
