Aric Almirola has filed a lawsuit in North Carolina Superior Court alleging that Earnhardt Ganassi Racing and Dale Earnhardt Inc. have breached their contract with him. Almirola, who drove in seven Sprint Cup races this year for the team before his car was parked because of a lack of sponsorship, filed the complaint last Thursday. DEI had announced last year that Almirola would run a full season in 2009, but the organization later merged its Cup operation with Chip Ganassi Racing to form Earnhardt Ganassi Racing. The complaint does not detail the circumstances surrounding the breach-of-contract claim and asks the court to refer the matter to arbitration. Almirola had filed two notices of a claim last month, and he had until Thursday to file the actual complaint. He is dismissing his claim against Chip Ganassi Racing and EGR co-owner Teresa Earnhardt but proceeding in the one against EGR and DEI. The team had no comment.

Aric is a good guy. Not doing bad in the Truck series either.
20th with only 14 starts out of 23 races. 9 top 10's and 6 top 5's.

Not really sure how to interpret that.....
suing the team is no way to induce another team to pick you up. there's still a lot of the good ol' boy way of doing things in NASCAR. while they understand that they have to have lawyers involved in a bunch of this stuff, they really don't care to be dragged into court.
it's like the Jeremy Mayfield deal. Mayfield is done, now he's trying to cash out with a big payday.

Unfortunately, this seems the only option in forcing arbitration. Prior to it, DEI & EGR would not even acknowledge the issue existed.

It seems that Theresa gets all the bad-mouthing, but doesn't anyone remember the name of Bobby Ginn? Talked a big game, bought into all these teams (including DEI & Almirola), and... POOF... disappeared, leaving all kinds of contract litigation in his wake. I recall Sterlig Marlin getting the same screwing, and he sued also. Not saying Ginn is at fault in this one, but there are quite a few shyster-owners out there too.
Aric just got caught in between people trying to bail out, and people who promised the world with no checkbook to pay for it all.

she didn't "let him walk". she practically forced him out.

I get it.
I really do.
He was just tired of knowing he'd be remembered as somebody who was given everything due to the color of his ancestor's skin and could do nothing with it.
Now when he is denied a future Sprint Cup, Nationwide, Bandalero or Mini Cup ride, he'll be able to say "It's all because of the lawsuit deal...it has nothing at all to do with my obvious lack of racing talent."
There is always a simple explanation. You just have to look for them sometimes.

It was back in oh....78' or 79'...can't remember that far back...you and me started side by side in the 7th row at Bristol. You pulled off because you wet yourself and I got wrecked on the pace lap by some 16 year old whose Daddy bought him a car from Junior Johnson.....don't you remember?

BTW....his career stats have been posted here many times before for people to decipher for themselves so I think I'll just let his record stand for itself.
