    Just another ambulance chasing hack law firm and opportunistic supposed fan. It is sad to see what society has turned into.

      The single limit lib ins will cover all the claims and they could have got 33% more buy filing there own claim.
      They think there is a difference with a big furm and might be right with a company that is not properly insured but NASCAR is not one of them.
      It will cost you money to take them to court and you might get a judgement for less than the insurer is willing to pay if you gust file a reg claim.
      I have seen this many times.
      In court for 3 to 5 years and get less compassion.

        Thanks for explaining that Don.

        I despise opportunistic people, the first thing on their minds is how much money can I get. hopefully NASCAR and Daytona Speedway fight them and they get nothing. Do the big tracks have a waiver of liability like out local tracks?

          There is no waver for spectators but they do post sighs that state its a dangers sport.
          The libilety ins is way over the top. Most judgments stay inside of the ins coverage .
          There are short tracks that have over 5 mill but the min that I know of is 500,000
          A death at a speedway claim might get as high as 3mil and could be paid without a lawer involved . The lawer would get 1 mil of that for filing the paper work when the ins is already in place.
          They are like buzards at the sign of road kill.
          There are times that they are needed for getting a judgement when the track does not have ample coverage but NASCAR is not one of them im sure.

              Do you know that these are just opportunistic people looking for a payday?

              Do you know if their injuries have been disclosed? If they are legitimately injured then they could be missing work and have lost wages. They may not be able to do things they once were able to do. Will they require ongoing medical treatment resulting in high medical bills?

                IMO, the track is negligent and should pay.

                Racing is never safe, but the plate tracks are patently unsafe and NASCAR knows it.

                Invite folks over for this weekend. If your septic tank is uncovered and one of their kids falls in and injures themselves, you are and should be liable.

                    If netting or etc will keep the ball out and it is not in place, then yes.

                    Look, I am all about free markets/keep your hands off my wallet/lawyers are...not good.

                    But in the earlier mentioned scenario--if the kids dug up the grass, pried off the top of the poo tank, and then jumped in, that is one thing. If you left the top off it is another.

                    It is not the injury. It is whether the injury could have been reasonably prevented, especially if the hosting facility (track, ball park, home, bar...) knows of the danger to the patrons/guests, and even more so if solutions exist to mitigate the danger and they are aware of them.

                      Awe c'mon guys, I'm sure nascar and the insurance company will hustle right over to do the right thing ville and take care of these people. Big companies and insurance companies are all about the little guy these days. Just take it easy, Nerone said it's gonna be ok and I trust his judgement.
